Introduction
Some people who use SHARE Scotland’s services are particularly vulnerable to abuse from the people around them. In order to protect our clients from risk of abuse, we take a number of steps to vet staff employed.
As well as seeking references for potential new employees, SHARE Scotland is registered with Disclosure Scotland, which allows us to carry out enhanced criminal background checks. These checks do not form part of the selection process, but are used to provide a final verification of successful candidates. These checks are only carried out on candidates who have been offered a post with SHARE Scotland.
Rehabilitation of Offenders Act (Exceptions) Order 1975
If you are applying to work with our client group you are covered by the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 as amended by the Rehabilitation of Offenders Act 1974 (Exceptions) (Amendment) Order 1986. This means that you are asked to disclose on the declaration from overleaf convictions that are “spent” under the terms of the Rehabilitation of Offenders Act 1974 and these convictions may be taken into account in assessing your suitability for the post applied.
Applicants are not entitled, therefore, to withhold information about previous convictions which would be regarded as spent for other appointments and you are required to list all previous convictions, regardless of how old you were when they happened. You should also list any criminal proceedings still pending. Failure to disclose relevant information, which we subsequently become aware of, will be regarded as a breach of trust. It is likely to result in you dismissal from SHARE Scotland, or withdrawal of an offer of employment.

What happens to this information?

Given the nature of the work, which SHARE carries out, particular care must be taken to enquire into the character and background of applicants for appointments to posts, which involve working with vulnerable individuals.
